VALID PRESCRIPTION REQUIRED

You certify that you have a valid prescription for the contact lenses you are ordering. You represent and warrant to Contactlensxchange by placing an order that the information you enter into the Site is valid and accurate and matches exactly your prescription as provided by your eye care provider. You further certify that you will renew your prescription in strict accordance with your eye care provider's suggested regime. You understand that Contactlens Xchange will not fulfill your order unless you have a valid prescription. You hereby consent to our contacting your eye care provider, if necessary, to verify your prescription information and any other necessary information. You are responsible for the accuracy of your own prescription power hence update your prescription carefully.

COLOR AND PRODUCT DESCRIPTION

We have made every effort to display as accurately as possible the colors of our products that appear on the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate. We have attempted to be as accurate as possible. However, we do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free. Most pictures shown at the site are graphic illustrations and may not represent the actual color used hence customer must exercise his or her own discretion.

DELIVERY

Deliveries will be as soon as possible to the address on your order and are "best effort" based. Subject to delays outside our control, the overall delivery period will not exceed 30 days.

COOLING-OFF PERIOD

You may cancel the order without stating any reason for doing so, such as within four (4) working days following the confirmation of your order ("the cooling-off Period"). Once an order is dispatched, no cancellation can be accepted. ( any custom lens ie toric lens and multifocal lens once processed cannot be canceled due to their unique prescription requirement.

OUR RIGHTS

We may elect to electronically monitor areas of the Site and may disclose any Content, records, or electronic communication of any kind (I) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate the Site; or (iii) to protect our rights or property or the rights of the users. We are not responsible for screening, policing, editing, or monitoring such Content. If notified of allegedly infringing, defamatory, damaging, illegal, or offensive Content, we may investigate the allegation and determine in our sole discretion whether to remove or request the removal of such Content from the Site.
We may terminate your access, or suspend your access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third party or us.
Because customer service is paramount to our business, we reserve the right to refuse to sell products to you if it reasonably appears to us that you intend to resell the products. In addition, we reserve the right to limit the quantities of items purchased by each customer.

TERMINATION

These terms are effective until terminated by either party. If you no longer agree to be bound by the Terms and Conditions of Use, you must cease your use of the Site. Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the Site with or without notice. You agree that any termination of your access to the Site may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the Site. 3. You have a valid prescription for such contact lenses, issued within the timeframe required by law in your jurisdiction of residence following a physical eye examination conducted by a registered eye care professional licensed in your country, state, province or other applicable jurisdiction;
4. You have not, since your last issuance of a valid prescription pursuant to a physical eye examination conducted by a registered eye care professional licensed in your country, state, province, or other applicable jurisdiction, suffered from any eye condition requiring treatment, and have not been advised to stop wearing contact lenses by an eye care professional or medical practitioner;
5. You understand that contact lenses must be properly cleaned, properly maintained, and used in strict conformance with the manufacturer's instructions and under the direction of your eye care professional. Before using the contact lenses, carefully review all instructions and information provided to you by your eye care professional and/or by the contact lens manufacturer. Failure to follow instructions for the cleaning, care, and use of your lenses could result in serious illness, disease, and possibly loss of vision. Use and care information provided on this website is for information purposes only, and while every effort is made to ensure its accuracy, it should not be relied upon;
6. You are aware that contact lenses are for your personal use only and must not be shared with anyone. Sharing of contact lenses can result in the transfer of microorganisms that can seriously damage your eyes, may lead to serious eye infection or blindness, and can spread infectious diseases. Never sleep in your contact lenses unless the manufacturer's instructions expressly allow it, and never wear contact lenses for a longer period than prescribed by your eye care professional or recommended by the contact lens manufacturer. If discomfort, irritation, watering, vision change, redness, or any other symptom occurs while you are wearing contact lenses, remove them immediately and consult an eye care professional;
7. You acknowledge that pursuant to the Copyright and Legal Disclaimer and Terms and Conditions of Sale, which you accepted, no responsibility or liability can be assumed by contactlensxchange.com, inc. or its affiliates, officers, directors, employees, or agents, relating to your purchase of contact lenses from us.
8. You acknowledge that your payment amount and the type of currency stated and confirmed during checkout may be subject to your country's bank admin charges and international currency fluctuation. You acknowledge that we (contactlensxchange - Lens Xchange) reserve the right to make changes to the content, price of the product, and terms of use without prior notice.
